Please read these Terms and Conditions carefully before using the website located at www.indypopphoto.com (the "Site") or booking any photography services offered by Indy Pop Photo ("we," "us," or "our"). By accessing or using this Site, or by booking our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Services
Indy Pop Photo provides professional photography services including, but not limited to, portrait sessions, family sessions, newborn photography, event photography, and any other photography services described on our website. The specific details of each session—including date, time, location, package, and pricing—will be outlined in a separate booking agreement or invoice at the time of booking.

2. Booking & Payment
A non-refundable retainer is required at the time of booking to reserve your session date. This retainer secures your spot and is applied toward your total session fee. The remaining balance is due on or before the date of your session, unless otherwise agreed upon in writing.
Accepted payment methods will be communicated at the time of booking. Failure to pay the remaining balance may result in cancellation of your session.

3. Cancellations & Rescheduling
We understand that life happens. If you need to reschedule, please notify us as soon as possible. We will do our best to accommodate rescheduling requests subject to availability. The retainer may be applied to a rescheduled date at our discretion.

Cancellations made less than 48 hours before the scheduled session will forfeit the retainer. In the event that we must cancel due to unforeseen circumstances (such as illness or an emergency), we will make every effort to reschedule your session, or your retainer will be refunded in full.

4. Copyright & Usage Rights
All photographs taken by Indy Pop Photo are the intellectual property of Indy Pop Photo and are protected under United States copyright law. By booking our services, you are granted a limited, non-exclusive, non-transferable personal license to use the delivered images for personal, non-commercial purposes only (such as printing, sharing on social media, or displaying in your home).
You may not:
• Sell or commercially license the photographs
• Submit the photographs for publication without prior written permission
• Apply filters, overlays, or other significant edits that alter the professional appearance of the images
• Remove or alter any watermarks or copyright metadata
Indy Pop Photo retains the right to use any images from your session for portfolio, website, social media, marketing, and promotional purposes, unless a written agreement stating otherwise has been signed prior to the session.

5. Image Delivery
Final edited images will be delivered digitally via an online gallery within the timeframe communicated at the time of booking (typically 2–4 weeks for portrait sessions). Rush delivery may be available for an additional fee.
We deliver a curated selection of the best images from your session. We do not deliver unedited, RAW, or outtake images under any circumstances.

6. Liability Limitation
Indy Pop Photo will make every effort to deliver exceptional results. However, in the unlikely event of equipment failure, file corruption, illness, or any other circumstances beyond our reasonable control, our liability is limited to a refund of monies paid. We are not responsible for any indirect, incidental, or consequential damages.
We strongly recommend backing up your delivered gallery promptly. Indy Pop Photo does not guarantee indefinite storage of your images after delivery.

7. Model Release
Unless a written opt-out is provided prior to your session, clients grant Indy Pop Photo permission to use session images for marketing, portfolio display, social media, and other promotional materials. We will never sell your images to third parties. If you wish to opt out, please notify us in writing before your session.

8. Website Use
The content on this website—including text, graphics, images, and logos—is the property of Indy Pop Photo and may not be copied, reproduced, or republished without prior written permission. The site is provided "as is" without warranties of any kind.
We reserve the right to update or change the content of this website at any time without notice. Links to third-party sites are provided for convenience only and do not imply endorsement.

9. Privacy
Your privacy is important to us. Please review our Privacy Policy [link to your Privacy Policy page] for information on how we collect, use, and protect your personal information.

10. Governing Law
These Terms and Conditions are governed by the laws of the United States and the state in which Indy Pop Photo operates. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
